About the site and registration requirements

This website is an e-commerce platform that allows businesses to list and sell products, and enables companies and individuals to purchase a variety of products. We reserve the right to introduce new services, update any existing services, or withdraw them at our sole discretion without liability.

You are eligible to register as a buyer or seller and benefit from the services if you meet the following eligibility criteria:

• For buyers: You must be of legal age to purchase products in your country of residence, and be able to provide an address in the Arab Republic of Egypt (“Egypt”) for product delivery.
• For sellers: You must have a registered business in accordance with your country’s laws, a valid business license, proof of authorization of the individuals making the registration, proof of identity of the authorized person, and provide supporting bank statements.

You acknowledge and agree that additional requirements may apply to certain product categories. We reserve the right to refuse any registration without explanation and to conduct any necessary checks. Once registration is successfully completed, it remains valid indefinitely and is subject to suspension or cancellation in accordance with these terms.

Obligations and prohibitions

• It is your responsibility to maintain privacy and restrict access to and use of your account and password, and you bear responsibility for all activities that take place in the name of your account.
• Notify us immediately of any unauthorized use of your account.
• Provide complete, truthful, accurate, and current information about yourself.
• Do not disclose to third parties the user information provided to you.
• Cooperate with requests from us to obtain additional information.

• Posting, listing, or uploading any inappropriate or prohibited content, including: content that is morally or religiously inappropriate, content that violates law, religious principles, and national security, the promotion of gambling, securities, living or dead creatures, weapons, alcohol, tobacco, drugs, medical drugs, chemicals, or defective, counterfeit, and misleading materials.
• Posting stolen material or material that you are not entitled to share.
• Breaking the law, or the rights of others, or circumventing our systems.
• Use the services if your account has been temporarily or permanently suspended.
• Failure to pay for products, or failure to deliver products you sold to customers (to sellers).
• Use contact information to increase your sales beyond the site's boundaries.
• Manipulating the price of any of the products or interfering with other users' listings.
• Posting unsolicited messages, viruses, or technologies that harm the site.
• Violating copyright, trademark, patent, and/or intellectual property rights of us or others, or collecting user information without their consent.

Intellectual property rights, guarantees and undertakings

All content on this website is our own property or the property of our licensors, including text, graphics, logos, images, and software. All rights and ownership of any information or materials you submit will become our property. You agree that you may not use our trademarks without our prior written consent.

You warrant, undertake and represent that:

• Full compliance with laws and regulations, including privacy laws and content regulation.
• You have full authority to contract, and the execution does not conflict with any other laws or agreements.
• If you create an account on behalf of a company, you are authorized to act on its behalf and guarantee its compliance, and the account is considered the property of that company.
• That any content you provide does not infringe on the rights of others anywhere in the world (including intellectual property rights).

The services are provided to you "as is" without warranties. We disclaim all express or implied warranties of merchantability or non-infringement of rights, and we do not guarantee that the services will be free from defects or malfunctions. As a buyer, you agree that we are not responsible for reviewing listings submitted by third parties. As a seller, you are responsible for the accuracy of the content of your listings.

Liability, compensation and cancellation

Nothing in these terms limits the liability of any party for fraud, death, or personal injury resulting from negligence. However, in all circumstances, we, our parent company, subsidiaries, affiliates, directors, and agents will not be liable for any claim related to loss of profits, loss of data, or any other financial loss or indirect damages arising from the use of the services, delays, viruses, or the actions of third parties.

If it is legally established that the exemption from liability does not apply, our total obligations to you, whether in contract or negligence, are limited to a maximum amount equal to the minimum value of:

• The price the product was sold for on the site and the original shipping prices.
• The amount of the disputed fees within 12 months, or
• Three hundred (300) Egyptian pounds.

You agree to indemnify and hold harmless us, our parent company, and our affiliates from any losses, damages, and expenses (including legal fees) arising out of: third-party claims resulting from your use of the Services, your breach of these Terms, violation of laws, or your content infringing on the intellectual property rights of others or containing libel and defamation.

We reserve the right to limit, suspend, or terminate your access to the Services, cancel any product orders, or delete your content at our sole discretion without liability. Any payments made for canceled orders will be refunded. We are committed to ensuring content compliance; if there is a violation, please notify us so we can investigate.

Betaliz and/or its affiliates provide you with other features and services. To enhance your experience, you agree that we may create additional services and/or accounts on your behalf using the information you provide to us.

The terms of sale are the conditions under which purchases are supplied and delivered to you, the buyer, on the website or application. Submitting your purchase order constitutes your acceptance of and agreement to these terms.

• Supplier: Each product is sold either by us or by a local or global seller.
• Acceptance: Acceptance is confirmed upon written notification. If acceptance is not possible, the product price will not be deducted.
• Payment: Your order authorizes payment. We accept payment by: (credit/debit card, e-wallet, cash on delivery for amounts up to EGP 25,000). To authorize payments, we may require you to open an account with one of our payment processing companies and accept their terms and conditions.
• Cancellation by us: We reserve the right to cancel your order in the event of non-payment, failure to provide us with information, non-receipt of the product, or in the event of an attempt to purchase multiple items in bulk, at our sole discretion.

• The cost and delivery date are as stated on the website.
• Delay: If there is a delay due to circumstances beyond our control, we will contact you as soon as possible. If you fail to receive your order, we will cancel it.
• Delivery from abroad: You may be registered as an importer, and you must check the laws and pay the fees and customs duties.
• Ownership and billing: The products become your property upon delivery and full payment. We will issue an electronic invoice and send it to your email.

Returns, exchanges, and refunds

Hazardous materials and flammable liquids, products used or damaged by you, consumables, products without a serial number, food, underwear, socks, personal care, medical baby products, and any product that has been opened or mixed for health reasons.

For products delivered and returned due to our error, we will issue a full refund, including return shipping fees. If the return is for other reasons, you will be responsible for return shipping costs.

• Cash on delivery: The value will be returned to your electronic wallet immediately after the product has been inspected.
• Credit card: Refunds are processed within (30) days of our receiving the product at the center.
• If you cancel before the shipping date, you will be automatically refunded.

Warranty, defects, and legal obligations for customers

This warranty protects your product against manufacturing defects. If the product is sold by a third-party seller, the seller's warranty terms apply. The warranty is limited to repair/replacement of the defective part or a refund. Repair does not extend the warranty period.

The warranty does not apply in the following cases: Unauthorized repair attempts, shocks and fractures, liquid damage, driver modifications (Root/Jailbreak), use of non-original accessories, removal of the serial number, replacement of consumables, and misuse.

You agree to comply with applicable laws and that you have the legal capacity to enter into this contract. If you purchase on behalf of a company, you confirm your authorization. Services are provided "as is" without warranties. Nothing in these terms excludes liability for fraud or death by negligence, but we (and our companies and suppliers) are not liable for any incidental damages or data loss resulting from delayed delivery, repairs, viruses, or site outages.

Our full legal liability towards you is limited to the maximum minimum value of: the product price and shipping costs, or three hundred (300) Egyptian pounds.

These Terms of Use and Sale, and any other non-contractual rights and obligations, are governed by and construed in accordance with the laws of the Arab Republic of Egypt. If a resolution cannot be reached within forty-five (45) days of your notifying us of the problem, the matter will be settled through the courts of the Arab Republic of Egypt.

The content of these terms shall not be construed as creating a partnership, agency, or joint venture between the parties. Each party is independent. A person who is not a party to these terms has no right to enforce any of their provisions.

These terms (and the documents referenced, including vendor contracts) constitute the entire agreement and supersede all prior agreements and negotiations. You may not modify these terms. We reserve the right to modify and add to them at any time, and your continued use of the site constitutes acceptance of such modifications.

If any provision of these Terms is deemed invalid or unenforceable, that provision will be nullified, and the remaining provisions will remain in full force and effect. You may not assign any of your obligations under these Terms without our written consent. Our assignment of any right shall not be deemed a continuing assignment unless expressly stated otherwise.

No party shall be held liable for any delay or failure to perform due to acts beyond its control (acts of God, legislative provisions, power outages, labor unrest, or the actions of subcontractors).
